A project filed with a flurry of Builder's Remedy applications earlier this year in Beverly Hills is undergoing changes, according to the city's list of current development projects.

A 10-story, 70-unit multifamily residential building proposed just south of Santa Monica and Beverly Boulevards, the project was also submitted to the city for review in February. The subject applicants and owners are once again Beachside Suites, LLC and Oak Investment Co., LLC.

As with the earlier iteration of the project, city records list the applicant as Beachside Suites, LLC - an entity managed by Builder's Remedy pioneer Leo Pustilnikov - and Oak Investment Co., LLC, which is affiliated with Beverly Hills-based Dromy International Investment Corp.

The Builder's Remedy, a once little-known element of state housing law, allows property owners who provide a requisite amount of affordable housing to bypass certain zoning rules relating to height and density in jurisdictions which have not received state certification for their housing elements. WS Communities made prolific use of the law earlier this year in Santa Monica, proposing more than a dozen projects totaling roughly 4,000 residential units before the city was able to secure certification.

In Beverly Hills, Pustilnikov has used the Builder's Remedy on a handful of sites, mostly notably a proposed 19-story building on Linden Avenue to the south of Wilshire Boulevard.

Pustilnikov was the first developer to make waves with the Builder's Remedy in Southern California, proposing a large mixed-use project which would bring over 2,700 homes and a hotel to the site of the AES power plant in Redondo Beach. While the city opted to deny the project, lawsuits from both the developer and advocacy groups have sought to force Redondo Beach to permit its construction.

The Maple Avenue site is not the only property in the near vicinity poised for density. The Beverly Hills City Council recently voted to partner with developer West Hollywood Community Housing Corp. to build 252 affordable apartments for seniors on a city-owned site at 9268-9298 W 3rd Street.
