Another meeting of the Beverly Hills Planning Commission brings the approval of two additional Builder's Remedy projects.

On October 23, Commissioners reluctantly gave the go-ahead to Fisch Properties for a proposed development at 9430 W. Olympic Boulevard. The project, which would replace an office building, calls for the construction of a 13-story building containing 53 one-, two-, and three-bedroom dwellings above a subterranean parking garage with space for 23 vehicles.

For eligibility as a Builder's Remedy project, plans call for 11 of the apartments to be set aside as low-income affordable housing.

Ottinger Architects is designing the contemporary glass-and-steel building, which would rise approximately 140 feet in height.

The project is one of four Builder's Remedy developments slated for sites along Beverly Drive and Olympic Boulevard, all of which are now approved.

On the eastern side of the City, Commissioners also approved a Builder's Remedy development from Beachside Suites, LLC and Oak Investment Co., LLC at 232 Tower Drive. Plans call for the construction of an eight-story edifice featuring 55 studio and one-bedroom apartments, including 11 affordable units.

As with the project on Olympic Boulevard, Ottinger Architects is designing 232 Tower.

The Builder's Remedy, a once little-known provision of state housing law, allows property owners or developers in a City with a non-compliant housing element to ignore certain zoning rules to build taller and denser projects than would otherwise be allowed. Builder's Remedy projects must either provide 20 percent of total units for lower-income renters or be reserved entirely for moderate-income households. 

Beverly Hills, which tried and failed on several occasions to gain certification of its housing element before finally achieving success in 2024, saw applications for roughly two dozen such projects while out of compliance. \
