As 2026 commences, Builder's Remedy shenanigans continue in Beverly Hills.
On January 13, the Beverly Hills City Council granted an appeal from applicant Wilshire Skyline regarding its project at 9229 Wilshire Boulevard. The proposed 14-story building would feature 116 studio, one-, two-, and three-bedroom apartments (including 24 affordable units), a 60-room hotel, approximately 7,300 square feet of ground-floor retail space, and subterranean parking for 140 vehicles.
Unlike plans for a similar high-rise from developer Crescent Heights on Burton Way, Wilshire Skyline's objections were not tied to a rejection of their project - but rather its approval. Prior to the October 29, 2025 hearing of the Beverly Hills Planning Commission, which approved the 14-story project, Wilshire Skyline had submitted a revised application calling for a larger 26-story building featuring 195 residential units and 252 parking spaces. The applicant had cited the recent passage of SB 92, which prohibits the inclusion of hotel uses in density bonus projects, and was perceived as a potential legal threat to the original plan.
Although staff contended that the submission of the new plan came outside of normal business hours, they also acknowledged the applicant's stated intent to not move forward with the original process. Given that, City Council adopted a motion to vacate the approval of the original plan and remand the item back to Planning Commission, which will now be tasked with processing the revised application, as requested by Wilshire Skyline.
The project was also the subject of a second appeal by neighbors of the property, which objects to the scale of the proposed development and purported procedural errors made by the Beverly Hills officials.
With or without the Builder's Remedy, Wilshire Skyline is already slated to build housing at 9229 Wilshire. The developer previously received approvals for a smaller eight-story development on the same property.
